Terms of Service

Agreement

These terms are a contract between you and Dash. By creating an account or using the app or this site, you agree to them. If you do not agree, do not use Dash.

Run safely — this is the important part

Dash puts a game on top of the real world. Checkpoints and powerups appear at real places, and chasing them can pull your attention away from where you are going. You are responsible for your own safety at all times.

• Watch the road, not the screen. Obey traffic laws and signals. Never cross a road, junction, or rail crossing to reach a checkpoint.
• Checkpoints are not vetted routes. A checkpoint appearing somewhere is not a claim that the route to it is safe, legal, public, or passable.
• Do not trespass. Skip any checkpoint on private property, closed land, or anywhere you are not permitted to be.
• Use your judgement about time and place. Weather, darkness, traffic, and unfamiliar areas are your call, not the app's.
• No running while driving or cycling. Do not use Dash while operating a vehicle.

Skip any checkpoint or powerup that you cannot reach safely and lawfully. Missing one costs you a streak; the alternative can cost a great deal more.

Health

Dash is a fitness and entertainment product, not a medical device, and nothing in it is medical advice. The pace, distance, and elevation figures we show are estimates derived from your device's GPS, and are not accurate enough to make health decisions on. Talk to a doctor before starting or intensifying an exercise programme, and stop running if you feel unwell.

Eligibility and your account

You must be at least 13 years old to use Dash, and old enough to enter a contract where you live. You are responsible for keeping your account credentials secure and for everything that happens under your account. Give us accurate information, and tell us promptly if you think your account has been compromised.

One person, one account. Do not share or sell your account.

Acceptable use

You agree not to:

• Falsify your location, spoof GPS, or record a run you did not actually run — including by car, bike, or treadmill emulator.
• Use bots, scripts, or modified clients to interact with Dash, or otherwise cheat a streak, leaderboard, or powerup.
• Harass, threaten, impersonate, or stalk another person, or use another user's route data to locate or follow them.
• Upload content that is unlawful, hateful, sexually explicit, or that you do not have the right to post.
• Scrape, bulk-download, reverse engineer, or attempt to gain unauthorised access to the service or another user's data.
• Interfere with the service — probing, load testing, or circumventing rate limits — without our written permission.

Your content

Your runs, username, avatar, and run descriptions remain yours. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display that content for the purpose of operating and improving Dash — for example, showing your run in a follower's feed. This licence ends when you delete the content or your account, except for copies already distributed to other users and residual copies in backups.

You are responsible for what you post, and you confirm you have the rights to post it. We may remove content that breaks these terms.

Powerups, streaks, and other virtual items

Powerups, checkpoints, streaks, and progress are part of a game. They have no monetary value, are not property, and cannot be redeemed, transferred, sold, or exchanged for anything of value. We may change, rebalance, expire, or remove any of them at any time, and we may reset progress obtained by cheating.

Pre-release software

Dash is in development and is provided on a pre-release basis. Expect bugs, downtime, missing features, and breaking changes. We may reset data during development, though we will avoid it where we can and give notice where we cannot. Do not rely on Dash as the only record of your training.

Third-party services

Dash depends on services we do not control, including your device's operating system, its location services, map and push notification providers, and the app store you installed it from. Their own terms apply to your use of them, and their failures can affect Dash.

Changes and availability

We may add, change, suspend, or discontinue any part of Dash at any time. We do not promise any particular level of availability. If we discontinue the service altogether, we will give you reasonable notice and an opportunity to export your data.

Termination

You may stop using Dash and delete your account at any time. We may suspend or terminate your access if you break these terms, if we are required to by law, or if we discontinue the service. Sections that by their nature should survive termination — content licences already granted, disclaimers, limitation of liability, and indemnity — do.

Disclaimer of warranties

DASH IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT LOCATION OR DISTANCE MEASUREMENTS WILL BE ACCURATE, OR THAT ANY ROUTE OR CHECKPOINT IS SAFE OR ACCESSIBLE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THESE EXCLUSIONS MAY NOT APPLY TO YOU.

Assumption of risk and limitation of liability

Running carries inherent risks of injury. You accept those risks, and you are solely responsible for your decisions about where, when, and how hard you run.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DASH AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED BY LAW, INCLUDING FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FOR FRAUD.

Indemnity

You agree to indemnify and hold Dash and its operators harmless from any claim, loss, or expense arising out of your use of the service, your content, or your breach of these terms.

Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of laws rules. If you are a consumer, this does not deprive you of the protections of the mandatory law of the country where you live.

Changes to these terms

We may update these terms. If a change is material, we will update the date above and notify you in the app or by email before it takes effect. Continuing to use Dash after a change means you accept the updated terms.
